Yep, possibly. But the chain of events seems:

Crew get gun out of Safe.
Crew use Gun for live practice.
Crew put Gun back in Safe.
Crew leave live rounds in Gun or in cache..
Armourrer retrieves Gun, checks or loads with blanks lol.
Assistant Director checks Gun and declaree it "cold".
Baldwin points Gun at Camera and Cinematographer and fires.

All those above steps seem a breach.

The Gun was left UNATTENDED for over 2 hours before the Assistant Director handed it to Baldwin. They also found a LIVE round in the Box of Dummies.

There seems to be some facts which are undisputed. The fact the Guns were left unattended prior to the Assistant Director passing one on seems undisputed.
The Police also stated live rounds were found.
