NEWARK — Two lingerie companies are in a pinch, facing class action suits from customers claiming that slimming shapewear did not zap pounds as advertised, according to a report in the New Jersey Law Journal.
The garments at the center of the suits were manufactured with a fabric called Novarel Slim, infused with small capsules of caffeine that are supposed to destroy fat. The material also contains retinol to promote firmer skin, according to the report.
Complaints filed in New Jersey, Massachusetts and Florida contain a statement from the Federal Commission indicating the promise that wearing Novarel Slim undergarments will melt pounds, "is about as credible as a note from the Tooth Fairy," according to the report
The companies named in the suits, Maidenform and Wacoal America, manufactured products with Novarel Slim, declaring that the fusion fabric would reduce the appearance of cellulite and even promote weight loss sans dieting.
One of the complaints, Caramore v. Maidenform Brands states "Defendants make these misrepresentations in order to prey upon women's insecurities about their body images."
The Caramore suit was filed in Brooklyn but moved to federal court in Newark, because Maidenform and Wacoal both are based in New Jersey, according to the report. Two other suits were filed in Boston and Tallahassee
