A BIKIE who cheated death after being shot several times in an ambush outside busy shopping centre won't talk to police, A major police manhunt is underway after Toby Mitchell, 37, was shot as horrified mothers and children ran for their lives, the Herald Sun reported. Mitchell, a champion kickboxer, was hit in the stomach outside Doherty's Gym, next to the bikie gang's Brunswick clubhouse in Weston St, and staggered 100m before falling in the Barkly Square shopping centre carpark yesterday afternoon.
He is in a critical but stable condition at the Royal Melbourne Hospital, but was well enough to speak today.
A stray bullet from the shooting that wounded the Bandido also struck a car with two children inside, police have revealed.


Investigator Detective Superintendent Brett Guerin said Mitchell had been shot in the back and hip and that his girlfriend Danielle McGuire - underworld kingpin Tony Mokel's former defacto - and others would be spoken to by investigators.

But he said Mitchell had been uncooperative when visited by police at the hospital.

But as the investigation continues, police said they believed two men were involved in the shooting yesterday and that both had fired shots.

Supt Guerin said the two men pulled up outside the gymnasium just before 5pm.

They were driving a a Ford Territory with stolen number plates.

"The passenger jumped out and let some shots go straightaway towards Mr Mitchell who ran away,'' Supt Guerin told Neil Mitchell's 3AW program.

"The driver of the vehicle then got out of the car and ran after him and let some shots go and we believe it was one of those shots that hit a vehicle driven by a man with his two kids in it.''
Supt Guerin said police believed the shooting was linked to Mr Mitchell's involvement in organised crime rather than his association with a bikie gang.

"There's an uninformed although understandable view amongst some people that we shouldn't really bother about criminals killing criminals but there's always the risk of collateral (damage),'' he said.

"There's the risk that people going about their lawful business and picking kids up from school or whatever this fellow was doing last night and found himself in the middle of a very very dangerous situation. A centimetre left or right could have resulted in far more tragic outcomes.''

Last night, police and firefighters were called to Parkville Ave, Parkville, where they found the 4WD on fire about 10.25pm.

A MFB spokesman said the car was still alight when crews arrived and took about 10 minutes to put out.

Firefighters stayed to help light the scene until the SES arrived.

Several heavily-tattooed bikies turned up to visit Mitchell at the Royal Melbourne Hospital this morning.

There are fears the shooting of the muscle-bound Mitchell - sergeant-at-arms of the gang's Australian wing - will be avenged.

Investigators will consider whether it is an internal feud gone wrong, an outbreak of violence with another outlaw club or an outsider with a grievance.

The anti-bikie Echo taskforce is involved in the investigation, which is being conducted by the armed crime taskforce.

The feared strongman - who has the word karma tattooed across his stomach - has been of interest to police for many years.

He was an associate of slain gangster Nik Radev before he was killed in 2003. Police that year interviewed Mitchell over the murder of Mark Mallia at Sunshine.

He was never charged and other men were convicted.

Acting Supt Stephen Mutton said it was sheer luck innocent bystanders had not been killed.

"We've got a shopping centre here, there are a lot of families doing their normal day-to-day business so it is a great concern to us," he said.

"Fortunately there's only been one person injured."

"Essentially he is the enforcer for the club," a source said.

Mitchell has been in a relationship with Tony Mokbel's former de facto wife, Danielle McGuire.
An angry Mokbel contacted Mitchell from Barwon Prison after learning of their relationship.
Mitchell had earlier in the day been seen in Doherty's Gym.

Police said the charcoal grey 2011 Territory involved in the shooting had number plates WIA-651.

A Carlton mother of two was shopping with her children when she heard what she thought was gunfire.
"At first, we thought it was a car backfiring. People were screaming and running," she said.

"It was like being in a movie."
A woman with a blood-smeared singlet was led from the scene by police.
Barkly Square food court attendant Dianne said: "We had women and children on the ground, there were shopping bags everywhere."

I dont know how people can suck at shooting so bad...

I did alot of shooting in the country as a kid.

Seems like more of a message ?? If these guys wanted him dead he simply would be.

First time I went clay pigeon shooting I obliterated the fuck out of the first 3 targets that flew up. True story broze. Things went downhill after the first 3 shots but, still, u get the message....my shit don't stink.

Ah speculation about someone intentions and we all haven't even seen the action.

The guy was very lucky to be alive so there is a good chance they wanted him dead.

It's easy to shoot something when your standing still but when your in a moving car trying not to be seen its a lot harder + he is not shooting at a clay target I'm sure Toby didn't run in one direction lol
Also if the shooter was drugged up at the time ? There are plenty of reasons why he missed so to speak .
